These general terms and conditions (GTC) of hillriders.ch, Schwäbisstrasse 12, 3613 Steffisburg (hereinafter "hillriders.ch") regulate the rights and obligations in connection with the use of the website www.hillriders.ch and the online shop on this site. The following general terms and conditions (GTC) apply between hillriders.ch and its customers in the version currently available and valid at the time of conclusion of the contract.

A customer is defined as any natural or legal person who maintains a business relationship with hillriders.ch. The general terms and conditions, the delivery and payment conditions and the data protection provisions may be adjusted from time to time.

For all product orders requiring a minimum age of 18, the customer confirms compliance with these legal provisions by placing the order.

Orders in quantities not exceeding normal household quantities may be rejected without justification.

These terms and conditions apply exclusively. Hillriders.ch reserves the right to change these terms and conditions at any time. Any terms and conditions that conflict with, supplement or deviate from these terms and conditions require the express written confirmation of hillriders.ch in order to be valid. When using www.hillriders.ch or when ordering goods or concluding a contract, the customer confirms that he or she fully accepts these terms and conditions, including the delivery and payment conditions.

Hillriders.ch contains information about products. Price and range changes as well as technical changes are reserved. All information on www.hillriders.ch (product descriptions, images, films, dimensions and other information) are only to be understood as approximate values ​​and in particular do not represent any assurance of properties or guarantees. Hillriders.ch endeavours to provide all information and details on www.hillriders.ch correctly, completely, up-to-date and clearly, but hillriders .ch makes no express or implied warranty for this.

Hillriders .ch cannot guarantee that the products listed are available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and can change at any time and without notice.

If the customer orders from a dealer based abroad who is not registered in the Swiss VAT register, the customer, as the importer of the products supplied by the dealer, is liable for the Swiss import tax and any customs duties.

Prices

All prices are gross in Swiss francs (CHF). Hillriders.ch is not subject to VAT.

Hillriders.ch has the right to change the price at any time. The price published at the time of the order applies. Additional costs (e.g. shipping costs, packaging costs, surcharges for certain means of payment) are not included in the price and are shown separately and may be charged additionally.

Technical changes, errors and misprints remain reserved; in particular, hillriders.ch may make price changes at any time and without prior notice.

Conclusion of contract

The offers on www.hillriders.ch represent an invitation to the customer to order products. By ordering via www. hillriders .ch, including the acceptance of these General Terms and Conditions, the customer gives a legally binding acceptance to conclude the contract.  The arrival of an online order is notified to the customer by means of an automatically generated order confirmation sent to the email address provided by them. Receipt of this order confirmation does not constitute a promise that the product can actually be delivered. It merely shows the customer that the order placed has arrived at the online shop and that the contract with hillriders.ch has been concluded subject to the condition that delivery is possible and the price is correct. Orders placed are binding for the customer. The purchase contract is only concluded when the customer has paid the full purchase price.

Orders will be delivered provided the goods are available and have been paid for in full. If it becomes apparent after the contract has been concluded that the ordered goods cannot be delivered or cannot be delivered in full, hillriders.ch is entitled to withdraw from the entire contract or from part of the contract. Any payment already made by the customer will be refunded accordingly. If no payment has been made, the customer is released from the obligation to pay. In the event of a contract termination, Hillriders.ch is not obliged to provide a replacement delivery or to pay any compensation.

payment

The customer has access to the payment options specified during the ordering process. Hillriders.ch reserves the right to exclude customers from individual payment options without giving reasons.

If the customer is in default with payment in whole or in part, hillriders.ch can also cancel and/or suspend all further orders without notice until the entire amount owed has been paid. Further claims for damages remain expressly reserved.

When purchasing with debit and credit cards, the charge is made at the time of the order. The data when paying with credit and debit cards is transmitted in encrypted form. The order is only processed once the corresponding payment has been received by hillriders.ch. If the payment has not been received by hillriders.ch within 5 days, hillriders.ch can cancel the order.

Warranty and Return

Right of return and exchange
The customer has no general right to return or exchange goods. The delivery note is considered a guarantee certificate. This must be kept carefully. In all cases, the return must be requested in writing via email. Returns are only possible up to 2 weeks (14 calendar days) after receipt of the goods. The date of delivery is decisive. The goods must be returned in their original packaging, complete with all accessories and with the delivery note enclosed. This is done at the customer's expense and risk.

What to do if your clothing is damaged
The customer can claim a defect in the garment, provided that there are no grounds for exclusion. Grounds for exclusion can include, in particular, elemental damage, moisture damage, impact or fall damage, natural wear and tear, damage caused by external influences. If there is a defect that does not fall under the grounds for exclusion, the customer should contact hillriders.ch personally by email at shop@hillriders.ch. In any case, the return to hillriders.ch must be confirmed in advance with hillriders.ch must agree on this. Otherwise, hillriders.ch can claim compensation for the expenses.

Returned clothing items that are not covered by the guarantee period, are sent to an incorrect address, whose return was not agreed upon and/or whose packaging was defective or where accessories are missing can be returned by hillriders.ch. No compensation for the inconvenience can be claimed.

Delivery, obligation to inspect and notification of defects

Hillriders.ch only ships ordered goods to customers with a residence in Switzerland.

The goods are sent by post or courier service to the address specified by the customer in the order. Upon dispatch, benefit and risk are transferred to the customer. Hillriders.ch is not liable for any damage caused by delayed arrival of the goods to the customer or to third parties.

If the delivery cannot be delivered or if the customer refuses to accept the delivery, hillriders.ch can terminate the contract after notifying the customer of the defect and setting a reasonable deadline and invoice the costs for the effort.

The customer must immediately check the delivered products for accuracy, completeness and delivery damage. Any defects for which hillriders.ch provides a guarantee must be reported immediately in writing by letter or email to hillriders.ch.

 

Warranty

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances.

Hillriders.ch is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that www.hillriders.ch, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of www.hillriders.ch will not infringe the rights of third parties who are not owned by hillriders.ch.

Liability

Hillriders.ch excludes any liability, regardless of its legal basis, as well as claims for damages against hillriders.ch and against any assistants and vicarious agents.  Hillriders .ch is not liable in particular for indirect damages and consequential damages, lost profits or other personal injuries, property damage and purely financial losses suffered by the customer. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.

Hillriders.ch uses hyperlinks solely to simplify the customer's access to other web offerings. Hillriders.ch cannot know the content of these web offerings in detail, nor can it accept liability or other responsibility for the content of these websites.

data protection

Hillriders.ch may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

Further instructions

Should individual provisions of these General Terms and Conditions be invalid and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come closest to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective and economic manner. The same applies to any gaps in the regulation.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
