Scope

These General Terms and Conditions (GTC) of hillriders.ch, Mülinenstrasse 31, 3626 Hünibach (hereinafter "hillriders.ch") govern the rights and obligations associated with the use of the website www.hillriders.ch and the online shop on this site. The following General Terms and Conditions (GTC) apply between hillriders.ch and its customers in the version currently available and valid at the time of contract conclusion.

A customer is defined as any natural or legal person who maintains a business relationship with hillriders.ch. The General Terms and Conditions, the delivery and payment conditions, and the privacy policy may be amended from time to time.

For all product orders requiring a minimum age of 18, the customer confirms compliance with these legal requirements by placing the order.

Orders in quantities not exceeding normal household quantities may be rejected without giving reasons.

These Terms and Conditions apply exclusively. Hillriders.ch reserves the right to change these Terms and Conditions at any time. Any conflicting, supplementary, or deviating terms and conditions require the express written confirmation of hillriders.ch to be valid. By using www.hillriders.ch, ordering goods, or concluding a contract, the customer confirms their full acceptance of these Terms and Conditions, including the delivery and payment terms.

Hillriders.ch contains information about products. Price and product range changes as well as technical changes are reserved. All information on www.hillriders.ch (product descriptions, images, videos, dimensions and other information) are only approximate values ​​and in particular do not represent any assurance of properties or guarantees. Hillriders.ch endeavours to provide all information on www.hillriders.ch correctly, completely, up-to-date and clearly. However, hillriders .ch makes no express or implied warranty for this.

Hillriders.ch cannot guarantee that the listed products will be available at the time of order. Therefore, all information regarding availability and delivery times is subject to change without notice.

If the customer orders from a dealer based abroad who is not registered in the Swiss VAT register, the customer, as the importer of the products supplied by the dealer, is liable for the Swiss import tax and any customs duties.

Prices

All prices are gross in Swiss francs (CHF). Hillriders.ch is not subject to VAT.

Hillriders.ch reserves the right to change prices at any time. The price published at the time of the order applies. Additional costs (e.g. shipping costs, packaging costs, surcharges for certain payment methods) are not included in the price and are shown separately and may be charged additionally.

Technical changes, errors and misprints are reserved; in particular, hillriders.ch may make price changes at any time and without prior notice.

Conclusion of contract

The offers on www.hillriders.ch represent an invitation to the customer to order products. By placing an order via www. hillriders .ch, including acceptance of these Terms and Conditions, the customer gives a legally binding acceptance to conclude the contract.  The arrival of an online order is notified to the customer via an automatically generated order confirmation sent to the email address provided by the customer. Receipt of this order confirmation does not constitute a guarantee that the product can actually be delivered. It merely informs the customer that the placed order has been received by the online shop and that the contract with hillriders.ch has been concluded, subject to availability and the correct price. Placed orders are binding for the customer. The purchase contract is only concluded when the customer has paid the full purchase price.

Orders will be delivered provided the goods are available and have been paid in full. If, after conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered or cannot be delivered in full, hillriders.ch is entitled to withdraw from the entire contract or from a part of the contract. Any payment already made by the customer will be refunded accordingly. If no payment has yet been made, the customer is released from the payment obligation. In the event of termination of the contract, hillriders.ch is not obligated to provide a replacement delivery or to pay any damages.

payment

The customer has access to the payment options specified during the ordering process. Hillriders.ch reserves the right to exclude customers from certain payment options without stating reasons.

If the customer defaults on payment in whole or in part, hillriders.ch may cancel and/or suspend all further orders without notice until the entire amount owed is paid. Further claims for damages remain expressly reserved.

When purchasing with debit or credit cards, the charge is made at the time of the order. Data for credit and debit card payments is transmitted using encrypted transmission. The order will not be processed until the corresponding payment has been received by hillriders.ch. If payment is not received by hillriders.ch within five days, hillriders.ch reserves the right to cancel the order.

Warranty and Return

Right of return and exchange
The customer has no general right of return or exchange. The delivery note serves as a warranty certificate. This must be kept carefully. Returns must always be requested in writing via email. Returns are only possible up to two weeks (14 calendar days) after receipt of the goods. The delivery date is decisive. The goods must be returned in their original packaging, complete with all accessories, and with the delivery note enclosed. Returns are made at the customer's expense and risk.

Procedure for damaged clothing
The customer may claim a defect in the garment, provided that no grounds for exclusion apply. Grounds for exclusion include, but are not limited to, damage caused by natural forces, moisture, impact or falls, natural wear and tear, and damage caused by external influences. If a defect does not fall under the grounds for exclusion, the customer should contact hillriders.ch personally by email at shop@hillriders.ch. In any case, the return to hillriders.ch must be preceded by hillriders.ch must be agreed upon. Otherwise, hillriders.ch may claim compensation for expenses.

Returned garments that are not covered by the warranty period, are sent to the wrong address, whose return was not agreed upon, and/or whose packaging was defective or where accessories are missing may be returned by hillriders.ch. No compensation for the costs incurred can be claimed.

Delivery, obligation to inspect and notification of defects

Hillriders.ch only ships ordered goods to customers residing in Switzerland.

The goods are Shipped by mail or courier to the address provided by the customer in the order. Upon shipment, risk and benefit are transferred to the customer. Hillriders.ch is not liable for any damages resulting from delayed arrival of the goods to the customer or third parties.

If the delivery cannot be made or if the customer refuses to accept the delivery, hillriders.ch may terminate the contract after notifying the customer of the defect and setting a reasonable deadline, and invoice the customer for the costs incurred.

Customers must immediately inspect delivered products for accuracy, completeness, and any damage. Any defects covered by hillriders.ch's warranty must be reported to hillriders.ch immediately in writing by letter or email.

 

Warranty

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects resulting from external circumstances.

Hillriders.ch is unable to provide any assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, or the constant or uninterrupted availability of www.hillriders.ch, its functionalities, integrated hyperlinks, and other content. In particular, it neither represents nor guarantees that the use of www.hillriders.ch will not infringe the rights of third parties not owned by hillriders.ch.

Liability

Hillriders.ch excludes any liability, regardless of its legal basis, as well as claims for damages against hillriders.ch and against any auxiliary persons and vicarious agents.  In particular, Hillriders.ch is not liable for indirect damages and consequential damages, lost profits, or other personal injury, property damage, or purely financial loss suffered by the customer. Further mandatory statutory liability, for example, for gross negligence or unlawful intent, remains reserved.

Hillriders.ch uses hyperlinks solely to facilitate customer access to other websites. Hillriders.ch has no knowledge of the detailed content of these websites, nor does it assume liability or other responsibility for the content of these websites.

Data protection

Hillriders.ch may process and use the data collected during the contract conclusion to fulfill its obligations under the purchase agreement and for marketing purposes. The data necessary to fulfill the service may also be shared with commissioned service partners (logistics partners) or other third parties.

Further provisions

Should individual provisions of these Terms and Conditions be invalid and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that most closely reflect the meaning and purpose of the invalid and/or ineffective provisions in a legally effective and economic manner. The same applies to any gaps in the regulation.

In the event of any dispute, Swiss substantive law shall apply exclusively, excluding conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
